What Information We Collect

When you register or enrol with us, we may collect:

  • Standard educational data (learning requirements, education type, subjects of interest, home ed declarations)
  • Your preferences regarding sessions, days, and times
  • If you are a service provider: your business name, services description, and professional profiles

Special Category & Safeguarding Data

To ensure the safety, wellbeing, and appropriate support of your child, we may collect highly sensitive "Special Category" data, which includes:

  • Medical needs, healthcare plans, allergies, dietary requirements, and GP details
  • Safeguarding flags, social worker details, legal/guardianship notes, court orders, and persons not authorised to collect
  • EOTAS details, local authority information, and SEND caseworker details

This data is physically segregated within our database and strictly access-controlled. It is only viewable by OpenSpace directors and core safeguarding staff on a strict need-to-know basis. General staff members cannot access these files.

Legal basis: Explicit consent (Article 9(2)(a) UK GDPR) and Substantial Public Interest for safeguarding purposes (Schedule 1, Data Protection Act 2018).

Why We Collect Your Information

Delivering our Services

When you enrol your child, we process personal data to manage bookings, process payments, and provide our educational and tutoring services. Legal basis: Performance of a contract (Article 6(1)(b) UK GDPR)

Service Planning and Delivery

We use your information to plan timetables, staffing, and facilities. Legal basis: Legitimate interests (Article 6(1)(f) UK GDPR)

Contacting You

We will contact you about sessions relevant to your interests and updates about OpenSpace. Legal basis: Consent (Article 6(1)(a) UK GDPR)

Market Research

We use aggregated, anonymised data to understand demand and apply for funding. Legal basis: Legitimate interests (Article 6(1)(f) UK GDPR)

Children's Data

We collect limited personal data about children provided by their parent, guardian, or local authority. We do not collect personal data directly from children. We process it only for the purposes described in this policy.

How Long We Keep Your Data

We retain data in accordance with UK statutory guidelines and the Limitation Act 1980:

  • Enrolled Student Records (General): Retained until the child reaches the age of 25
  • Safeguarding & Child Protection Files: Retained securely until the child's 25th birthday, in line with UK statutory safeguarding best practice
  • Accident & Incident Reports (Children): Retained until the child reaches the age of 21 (or age 25 if the incident relates to a safeguarding concern)
  • Interest Register Data: Retained for up to 2 years from submission, or until you request deletion
  • Provider Enquiry Data: Retained for 2 years from the date of enquiry
  • Anonymised Data: Aggregated planning data may be retained indefinitely

Who We Share Your Data With

We do not sell your personal data. Your data is stored and processed using secure, enterprise-grade infrastructure:

Base44 (UK Database)

We use Base44 to host our secure, encrypted UK-based database. Base44 acts as our Data Processor.

Google Workspace

We use secure, encrypted enterprise Google Drive for document storage.

Secure Offline Backups

We maintain highly secure, encrypted offline backups stored in a locked, fireproof safe to ensure data integrity and disaster recovery.

Specialist Staff and Providers

We may share strictly limited information with vetted specialists at OpenSpace solely for planning appropriate support. This is done through secure, automated access controls on a need-to-know basis.

Your Rights Under UK GDPR
